Principalele modific\u0103ri \u021bin de urm\u0103toarele aspecte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>munca \u00een perioada concediului de maternitate;<\/li>\n\n\n\n<li>introducerea unui nou tip de concediu (concediul social nepl\u0103tit);<\/li>\n\n\n\n<li>mecanismul de folosire a concediului de odihn\u0103 anual.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Concediile \u00een 2024: Munca \u00een perioada concediului de maternitate<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aceast\u0103 modificare presupune c\u0103 salariatele care se afl\u0103 \u00een concediul de maternitate au dreptul s\u0103-\u0219i continue activitatea de munc\u0103. Pentru asta, e nevoie s\u0103 scrie o cerere la care va anexa concluzia privind starea de s\u0103n\u0103tate, eliberat\u0103 de c\u0103tre institu\u021bia medico-sanitar\u0103 pe a c\u0103rei list\u0103 este \u00eenregistrat\u0103. Acesta prevede c\u0103 salaria\u021bii pot beneficia de un concediul nepl\u0103tit pentru \u00eengrijirea unei persoane care locuie\u0219te \u00een aceea\u0219i locuin\u021b\u0103 cu ei. Acest concediu social nepl\u0103tit se acord\u0103 \u00een baza unei cereri scrise, pe o durat\u0103 de p\u00e2n\u0103 la 5 zile lucr\u0103toare \u00eentr-un an calendaristic.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mecanismul de folosire a concediului de odihn\u0103 anual<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">O alt\u0103 modificare f\u0103cut\u0103 la Codul Muncii \u021bine de mecanismul de folosire a concediului de odihn\u0103 anual. Drept urmare, dac\u0103 salariatul, din motive \u00eentemeiate, confirmate documentar, nu \u00ee\u0219i poate folosi concediul de odihn\u0103 anual la care avea dreptul \u00een anul calendaristic corespunz\u0103tor, cu acordul salariatului \u00een cauz\u0103, angajatorul este obligat s\u0103-i acorde acestuia concediul de odihn\u0103 nefolosit \u00een decurs de doi ani, \u00eencep\u00e2nd cu anul urm\u0103tor celui \u00een care i s-a acordat dreptul la concediul de odihn\u0103 anual.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Concediile \u00een 2024 \u2013 la ce aspecte ar trebui s\u0103 fie aten\u021bi angajatorii<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Cine poate solicita noul tip de concediu social nepl\u0103tit<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Orice salariat poate solicita concediul nepl\u0103tit pentru \u00eengrijirea unei persoane care locuie\u0219te \u00een aceea\u0219i locuin\u021b\u0103 cu el. Dup\u0103 cum am men\u021bionat, acest concediu se acord\u0103&nbsp; pe o durat\u0103 de 5 zile lucr\u0103toare, \u00een baza unei cereri scrise.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Ce acte trebuie s\u0103 cear\u0103 angajatorul de la salaria\u021bi<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La cerere se vor anexa urm\u0103toarele acte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copie a actului de identitate al persoanei pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul;<\/li>\n\n\n\n<li>declara\u021bia pe propria r\u0103spundere a salariatului din care s\u0103 rezulte faptul c\u0103 persoana pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul locuie\u0219te \u00een aceea\u0219i locuin\u021b\u0103 cu salariatul;<\/li>\n\n\n\n<li>un certificat medical al persoanei pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul, eliberat de o institu\u021bie medico-sanitar\u0103.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Concediul de odihn\u0103 anual. Cine informeaz\u0103 angaja\u021bii<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen cazul concediului de odihn\u0103 anual, angajatorul trebuie s\u0103 anun\u021be angajatul despre c\u00e2te zile de concediu acumulate are etc? Ce alte responsabilit\u0103\u021bi \u00eei mai revin angajatorului \u00een leg\u0103tur\u0103 cu ultimele modific\u0103ri legislative (ce \u021bin de concedii) din Codul Muncii?)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La sf\u00e2r\u0219itul fiec\u0103rui an calendaristic, angajatorul e obligat s\u0103 informeaz\u0103 salariatul, despre num\u0103rul zilelor de concediu de odihn\u0103 anual acumulate\/nefolosite, termenul de expirare a acestora \u0219i s\u0103 dispun\u0103 utilizarea zilelor de concediu de odihn\u0103 anual acumulate\/nefolosite de c\u0103tre salariat, conform program\u0103rii stabilite de comun acord. Aceast\u0103 informare poate fi f\u0103cut\u0103 at\u00e2t \u00een form\u0103 scris\u0103, pe suport de h\u00e2rtie, c\u00e2t \u0219i \u00een form\u0103 electronic\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Despre concediul de odihn\u0103 anual nefolosit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Concediul de odihn\u0103 anual nefolosit poate fi \u00eenlocuit printr-o compensa\u021bie \u00een bani? \u00cen ce situa\u021bie?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nu, categoric nu! Legea spune c\u0103 nu se admite \u00eenlocuirea concediului de odihn\u0103 anual nefolosit printr-o compensa\u021bie \u00een bani. Totu\u0219i, exist\u0103 o excep\u021bie, \u0219i anume cazurile de \u00eencetare a contractului individual de munc\u0103 al salariatului care nu \u0219i-a folosit concediul din motive \u00eentemeiate, confirmate documentar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Concediile \u00een 2024 \u2013 ce spune expertul DAD despre acest subiect<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Am discutat despre principalele modific\u0103ri legislative cu privire la concedii cu <a href=\"https:\/\/dad.md\/dad-human-capital\/cunoaste-specialistul-dad-in-administrarea-actelor-hr\/\" target=\"_blank\" rel=\"noreferrer noopener\">Corina Burlea<\/a>, manager \u00een domeniul resurselor umane la DAD Group. Ce presupune asta?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Angajatele pot activa \u00een perioada concediului de maternitate p\u00e2n\u0103 \u00een 36 luni de sarcin\u0103.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Pentru a beneficia de aceast\u0103 posibilitate angajata depune o cerere prin care solicit\u0103 activarea \u00een perioada concediului de maternitate, prezint\u0103 certificat medical eliberat de medicul de familie, cu men\u021biunea \u2013 apt\u0103 de munc\u0103.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u00cen baza actelor depuse, angajatorul emite ordin.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Despre concediul social nepl\u0103tit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>O alt\u0103 modificare este introducerea unui nou tip de concediu (concediul social nepl\u0103tit). Spune-ne cine poate beneficia de acest concediu \u0219i care sunt condi\u021biile?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cu \u00eencepere din aprilie 2024, angajatul poate solicita un concediu nepl\u0103tit cu o durata de p\u00e2n\u0103 la <em>5 zile anual, pentru \u00eengrijirea unei persoane care locuie\u0219te \u00een aceea\u0219i locuin\u021b\u0103 cu salariatul. La cerere se ata\u0219eaz\u0103:<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8211; copia actului de identitate al persoanei pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8211; declara\u021bia pe propria r\u0103spundere a salariatului din care s\u0103 rezulte faptul c\u0103 persoana pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul locuie\u0219te \u00een aceea\u0219i locuin\u021b\u0103 cu salariatul;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8211; un certificat medical al persoanei pentru a c\u0103rei \u00eengrijire se solicit\u0103 concediul, eliberat de o institu\u021bie medico-sanitar\u0103.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Concediul social nepl\u0103tit vs concediul nepl\u0103tit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Care e deosebirea dintre acest tip de concediu \u0219i concediul nepl\u0103tit?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Concediul nepl\u0103tit \u00eei poate fi refuzat angajatului. Sau altfel spus, salariatului i se poate acorda concediul nepl\u0103tit cu consim\u021b\u0103m\u00e2ntul angajatorului.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Din con\u021binutul normei, concediul pentru \u00eengrijirea unei persoane care locuie\u0219te la acela\u0219i domiciliu, acest timp de concediu nu poate fi refuzat de angajator.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cum \u00eei ajut\u0103m pe clien\u021bii no\u0219tri<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cum serviciul de gestionare a documenta\u021bii de personal prestat de DAD \u00eei ajut\u0103 pe antreprenori anume \u00een ce \u021bine de acordarea concediilor? Ce responsabilit\u0103\u021bi ne asum\u0103m noi?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Recomandam angajatorilor sa \u00eencurajeze plecarea \u00een concedii anuale a angaja\u021bilor, cel pu\u021bin o dat\u0103 \u00een an pentru o durat\u0103 de minim 14 zile. Un angajat odihnit este un angajat productiv care aduce valoare companiei.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Totodat\u0103, noi inform\u0103m continuu angajatorii.
