{"id":3045,"date":"2023-11-22T15:06:24","date_gmt":"2023-11-22T12:06:24","guid":{"rendered":"https:\/\/dad.md\/dad-human-capital\/?p=3045"},"modified":"2024-07-11T15:06:15","modified_gmt":"2024-07-11T12:06:15","slug":"salariul-minim","status":"publish","type":"post","link":"https:\/\/dad.md\/dad-human-capital\/salariul-minim\/","title":{"rendered":"De ce nu le po\u021bi da la to\u021bi angaja\u021bii salariul minim"},"content":{"rendered":"\n<p>Salariul este recompensa \u00een bani, pe care tu, ca angajator, o pl\u0103te\u0219ti angaja\u021bilor t\u0103i pentru munca pe care o fac sau urmeaz\u0103 s\u0103 o fac\u0103 \u00een baza contractului individual de munc\u0103. \u0218i pentru c\u0103 salariile \u00eenseamn\u0103 cheltuieli (salariul \u00een sine + impozitele), mul\u021bi angajatori \u00ee\u0219i doresc s\u0103 ofere un salariu c\u00e2t mai mic posibil, adic\u0103, salariul minim pe economie. Din p\u0103cate sau din fericire, acest lucru nu e \u00eentotdeauna posibil. Iar ast\u0103zi vorbim anume despre acest subiect, \u00ee\u021bi explic\u0103m cum s\u0103 stabile\u0219ti corect salariile \u0219i de ce nu le po\u021bi da la to\u021bi angaja\u021bii <strong>salariul minim<\/strong>.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Salariul minim \u2013 ce este \u0219i de ce depinde m\u0103rimea acestuia<\/h1>\n\n\n\n<p><strong>Salariul minim<\/strong> reprezint\u0103 remunerarea minim\u0103, sub nivelul c\u0103reia angajatorul nu este \u00een drept s\u0103 pl\u0103teasc\u0103 un angajat pentru norma de munc\u0103 pe lun\u0103 sau pe or\u0103 \u00eendeplinit\u0103 de acel angajat. Altfel spus, cel mai mic salariu posibil (din punct de vedere legal).<br><br><strong>Important!<\/strong> Cuantumul <strong>salariului minim<\/strong> este stabilit de c\u0103tre stat, e evaluat \u00een moneda na\u021bional\u0103 \u0219i este obligatoriu pentru to\u021bi angajatorii (persoane juridice \u0219i persoane fizice) care utilizeaz\u0103 munca salariat\u0103, indiferent de tipul de proprietate \u0219i de forma juridic\u0103 de organizare. M\u0103rimea <strong>salariului minim<\/strong> nu poate fi diminuat\u0103 nici prin contractul colectiv de munc\u0103, nici prin contractul individual de munc\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cum se stabile\u0219te salariul minim \u0219i care este m\u0103rimea acestuia \u00een 2023<\/h2>\n\n\n\n<p>La stabilirea cuantumului <strong>salariului minim<\/strong> se \u021bine cont de urm\u0103toarele aspecte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>condi\u021biile economice;<\/li>\n\n\n\n<li>rata infla\u021biei;<\/li>\n\n\n\n<li>modificarea pre\u021burilor de consum,;<\/li>\n\n\n\n<li>evolu\u021bia salariului mediu pe economie;<\/li>\n\n\n\n<li>volumul produsului intern brut;<\/li>\n\n\n\n<li>productivitatea muncii;<\/li>\n\n\n\n<li>valoarea minimului de existen\u021b\u0103.<\/li>\n<\/ul>\n\n\n\n<p>Din 1 ianuarie a anului curent, <strong>salariul minim<\/strong> pentru un program de lucru complet (de 169 de ore \u00een medie pe lun\u0103) constituie 4 000 de lei.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>De ce antreprenorii vor s\u0103 ofere salariul minim <\/strong><\/h3>\n\n\n\n<p>Motivul e unul simplu. Majoritatea angajatorilor vor s\u0103 ofere salarii minime, pentru a economisi. Vor s\u0103 economiseasc\u0103 pe salarii, s\u0103 pl\u0103teasc\u0103 mai pu\u021bine impozite \u0219i mai pu\u021bine taxe.<br><br>\u0218i cumva e de \u00een\u021beles. Cine nu vrea s\u0103 economiseasc\u0103. S\u0103 analiz\u0103m un exemplu. Presupunem c\u0103 ai nevoie de un contabil \u0219i \u00eei oferi 10 000 de lei (net). Asta \u00eenseamn\u0103 c\u0103 va trebui s\u0103 mai achi\u021bi fondul social (24%) \u2013 2 997 de lei; asigurarea medical\u0103 obligatorie (9%) \u2013 1 123,88 lei; impozitul pe venit (12%) \u2013 1 363,64 lei. \u00cen total, pe impozite se duc 5 484,52 lei. Iar asta \u00eenseamn\u0103 c\u0103 un salariu net de 10 000 de lei te cost\u0103 15 484,52 lei.<br><br>Dac\u0103 facem acela\u0219i exerci\u021biu cu suma de 4 000 de lei, \u0219i impozitele vor fi mai mici. Pentru un salariu net de 4 000 de lei, vei achita un salariu total de 6 193,80 lei.<br><br>Apropo, <strong>salariul minim<\/strong> a crescut constant \u00een ultimii ani. \u00cen 2019, acesta constituia 2 775 de lei, \u00een 2020 \u0219i 2021 era de 2 935 de lei, \u00een 2022 a ajuns la 3 500 de lei \u0219i \u00een 2023 constituie 4 000 de lei. Din asta reiese c\u0103 po\u021bi achita un salariu minim doar angaja\u021bilor care fac o astfel de munc\u0103. Deci, angaja\u021bilor necalifica\u021bi, care \u00eendeplinesc o munc\u0103 simpl\u0103.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Studiu de caz:<\/h4>\n\n\n\n<p>Ion are o fabric\u0103 de confec\u021bii. De cur\u00e2nd, caut\u0103 s\u0103 angajeze o persoan\u0103 care s\u0103 fac\u0103 ordine \u00een \u00eenc\u0103pere. Programul de munc\u0103 e obi\u0219nuit, de luni p\u00e2n\u0103 vineri, c\u00e2te 8 ore pe zi. Poate Ion s\u0103-i pl\u0103teasc\u0103 noului angajat <strong>salariul minim<\/strong>?<br><br>Da, poate! Pentru c\u0103 persoana angajat\u0103 va face o munc\u0103 simpl\u0103, necalificat\u0103.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Studiu de caz:<\/h4>\n\n\n\n<p>Acela\u0219i Ion cu aceea\u0219i fabric\u0103 de confec\u021bii. Numai c\u0103 de data asta caut\u0103 un contabil. Poate el s\u0103-i pl\u0103teasc\u0103 noului angajat <strong>salariul minim<\/strong>?<br><br>Nu, nu poate! Pentru c\u0103 munca de contabil e o munc\u0103 ce necesit\u0103 calificare.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sistemul tarifar \u0219i sistemul netarifar de salarizare<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Sistemul tarifar de salarizare<\/h4>\n\n\n\n<p>Sistemul tarifar de salarizare reprezint\u0103 totalitatea normativelor care determin\u0103 diferen\u021bierea salariului \u00een func\u021bie de calitatea, volumul \u0219i condi\u021biile de munc\u0103.<\/p>\n\n\n\n<p>Salariul tarifar se stabile\u0219te prin negocieri colective la nivel de ramur\u0103. M\u0103rimea acestuia trebuie s\u0103 fie cel pu\u021bin egal\u0103 cu m\u0103rimea <strong>salariului minim<\/strong> stabilit de Guvern pentru anul respectiv. La nivel de unitate din ramurile respective \u2013 salariul nu trebuie s\u0103 fie mai mic dec\u00e2t cuantumul stabilit la nivel de ramur\u0103.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Sistemul netarifar de salarizare<\/h4>\n\n\n\n<p>Sistemele netarifare de salarizare reprezint\u0103 modalit\u0103\u021bi de diferen\u021biere a salariilor \u00een func\u021bie de performan\u021bele individuale sau colective ale salaria\u021bilor \u0219i func\u021biile de\u021binute de ace\u0219tia. Criteriile de evaluare a performan\u021belor profesionale individuale ale angaja\u021bilor se stabilesc de c\u0103tre angajator. Tot angajatorul e cel care apreciaz\u0103 aceste performan\u021be.<\/p>\n\n\n\n<p>La nivel de unitate, sistemul netarifar de salarizare se stabile\u0219te \u00een contractul colectiv de munc\u0103. \u00cen cadrul sistemelor netarifare de salarizare, angajatorul stabile\u0219te m\u0103rimea salariului primit de fiecare angajat al s\u0103u. Totu\u0219i, angajatorul trebuie s\u0103 respecte, drept limit\u0103 minim\u0103, salariul minim.<\/p>\n\n\n\n<p><strong>Cite\u0219te \u0219i: <a href=\"https:\/\/dad.md\/dad-human-capital\/angajati-buni-cu-salarii-mici\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cum s\u0103 atragi angaja\u021bi buni chiar dac\u0103 oferi salarii mici<\/a><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cum s\u0103 stabile\u0219ti ce salariu trebuie s\u0103-i dai unui angajat<\/h3>\n\n\n\n<p>M\u0103rimea salariilor, formele \u0219i condi\u021biile de salarizare se stabilesc prin negocieri colective sau individuale \u00eentre angajator \u0219i salaria\u021bi. Se negociaz\u0103 \u00een func\u021bie de posibilit\u0103\u021bile financiare ale angajatorului. Apoi, toate aceste aspecte \u2013 m\u0103rimea salariului, condi\u021biile etc. se fixeaz\u0103 \u00een contractul colectiv de munc\u0103 \u0219i \u00een contractul individual de munc\u0103.<br><br>Nimeni nu te poate impune s\u0103 dai salariul X sau salariul Y unui angajat. Totu\u0219i, exist\u0103 o limit\u0103 inferioar\u0103 de la care e\u0219ti obligat s\u0103 porne\u0219ti \u0219i ni\u0219te recomand\u0103ri de care e bine s\u0103 \u021bii cont. E bine, pentru c\u0103 te ajut\u0103 s\u0103 evaluezi obiectiv valoarea unei munci. \u00ce\u021bi spune de ce criterii trebuie s\u0103 \u021bii cont, la ce aspecte s\u0103 fii atent etc.<br><br>Dup\u0103 cum deja ne-am l\u0103murit, acea limit\u0103 inferioar\u0103 e <strong>salariul minim<\/strong>. Fie c\u0103 achi\u021bi pe or\u0103 sau pe s\u0103pt\u0103m\u00e2n\u0103 trebuie s\u0103 \u021bii cont de m\u0103rimea salariului minim din anul respectiv. Pentru 2023, de exemplu, e stabilit salariul de 4 000 de lei lunar, pentru o norm\u0103 \u00eentreag\u0103. Asta \u00eenseamn\u0103 23,67 de lei pe or\u0103.<br><br>Drept urmare, dac\u0103 salariatul e angajat pe o norm\u0103 \u00eentreag\u0103, nu ai voie s\u0103-i achi\u021bi mai pu\u021bin de 4 000 de lei pe lun\u0103. Mai mult se poate, iar uneori chiar trebuie. Mai pu\u021bin \u2013 NU! Dac\u0103 acesta nu e angajat pe o norm\u0103 \u00eentreag\u0103, nu ai voie s\u0103-i achi\u021bi mai pu\u021bin de 23,67 de lei pe ora de munc\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><br>Intervalul<strong> <\/strong>pentru<strong> <\/strong>stabilirea<strong> <\/strong>salariilor<\/h3>\n\n\n\n<p>Buuun! Acum s\u0103 trecem la recomand\u0103ri. Exist\u0103 Anexa nr. 4 la <a href=\"https:\/\/www.legis.md\/cautare\/getResults?doc_id=137429&amp;lang=ro\">Hot\u0103r\u00e2rea Guvernului<\/a> nr. 743\/2002. Acolo se propune un interval pentru stabilirea salariilor.<br><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"887\" height=\"826\" src=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2023\/11\/Anexa-4-fotografie.png\" alt=\"\" class=\"wp-image-3046\" srcset=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2023\/11\/Anexa-4-fotografie.png 887w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2023\/11\/Anexa-4-fotografie-300x279.png 300w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2023\/11\/Anexa-4-fotografie-768x715.png 768w\" sizes=\"auto, (max-width: 887px) 100vw, 887px\" \/><\/figure>\n\n\n\n<p><strong>Important!<\/strong> Intervalul pentru stabilirea salariilor tarifare\/de func\u021bie calculate aplic\u00e2nd coeficientul de complexitate pe tipuri de lucr\u0103ri \u0219i ramuri ale economiei na\u021bionale cu valoarea 1,00 are un caracter orientativ \u00een procesul de negociere al p\u0103r\u021bilor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><br>De ce criterii s\u0103 \u021bii cont c\u00e2nd stabile\u0219ti salariile angaja\u021bilor<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>cererea \u0219i oferta for\u021bei de munc\u0103 pe pia\u021ba muncii;<\/li>\n\n\n\n<li>cantitatea, calitatea \u0219i complexitatea muncii;<\/li>\n\n\n\n<li>condi\u021biile de munc\u0103;<\/li>\n\n\n\n<li>calit\u0103\u021bile profesionale ale salariatului;<\/li>\n\n\n\n<li>efortul \u0219i responsabilit\u0103\u021bile salariatului;<\/li>\n\n\n\n<li>natura \u0219i rezultatele muncii lui;<\/li>\n\n\n\n<li>rezultatele activit\u0103\u021bii economice a unit\u0103\u021bii.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><br>Ce factori NU trebuie s\u0103 influen\u021beze \u00een nici un fel m\u0103rimea salariilor<\/h3>\n\n\n\n<p>Salariile nu trebuie s\u0103 depind\u0103 de apartenen\u021ba politic\u0103, de religie sau de genul angajatului. De asemenea, nu trebuie s\u0103 fie influen\u021bat de orientarea sexual\u0103, ras\u0103, etnie etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><br>Important de re\u021binut!<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>M\u0103rimea salariului minim este stabilit\u0103 de c\u0103tre stat, e evaluat\u0103 \u00een moneda na\u021bional\u0103 \u0219i este obligatorie pentru to\u021bi angajatorii (persoane juridice \u0219i persoane fizice) care utilizeaz\u0103 munca salariat\u0103, indiferent de tipul de proprietate \u0219i de forma juridic\u0103 de organizare.<\/li>\n\n\n\n<li>M\u0103rimea salariului minim nu poate fi schimbat\u0103 nici prin contractul colectiv de munc\u0103, nici prin contractul individual de munc\u0103.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Po\u021bi acorda salariul minim numai angaja\u021bilor care presteaz\u0103 o munc\u0103 simpl\u0103, necalificat\u0103.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00cen 2023, salariul minim pentru un program de lucru complet (de 169 de ore \u00een medie pe lun\u0103) constituie 4 000 de lei.
