Acesta se nume\u0219te concediu paternal \u0219i poate fi solicitat de orice tat\u0103 salariat, care este angajat oficial \u0219i beneficiaz\u0103 de asigurare social\u0103. De cur\u00e2nd <strong>concediul paternal <\/strong>a fost extins.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">C\u00e2nd poate fi luat concediul paternal?<\/h1>\n\n\n\n<p>Legisla\u021bia muncii ofer\u0103 dreptul la concediu paternal tat\u0103lui copilului nou-n\u0103scut pentru a putea participa efectiv la \u00eengrijirea nou-n\u0103scutului. Cu condi\u021bia de a fi asigurat \u00een cadrul sistemului asigur\u0103rilor sociale de stat.<\/p>\n\n\n\n<p>Tat\u0103l copilului nou-n\u0103scut beneficiaz\u0103 de dou\u0103 tipuri de concedii paternale cu durat\u0103 diferit\u0103 \u0219i achitare din diverse surse.<\/p>\n\n\n\n<p>Conform art. 11<sup>1<\/sup> din Conven\u021bia colectiv\u0103 (nivel na\u021bional) nr. 2 din 9 iulie 2004 (MO161-165 din 26.06.15), tat\u0103l copilului nou-n\u0103scut beneficiaz\u0103 de dreptul la un concediu paternal cu o durat\u0103 de 3 zile calendaristice, cu men\u021binerea salariului mediu.<\/p>\n\n\n\n<p><strong>Concediul paternal<\/strong> se acord\u0103 \u00een primele 56 de zile de la na\u0219terea copilului, \u00een baza unei cereri scrise a salariatului. Concediul se acord\u0103 la cererea salariatului. La cerere se anexeaz\u0103 copia certificatului de na\u0219tere al copilului.<\/p>\n\n\n\n<p>Calculul \u0219i achitarea indemniza\u021biei pentru <strong>concediul paternal<\/strong> se efectueaz\u0103 de entitate \u00een baza punctului 5 din Hot\u0103r\u00e2rea Guvernului nr. 426 din 26 aprilie 2004 privind aprobarea Modului de calculare a salariului mediu.<\/p>\n\n\n\n<p>Guvernul RM, \u00eencep\u00e2nd cu 27 mai 2016 (MO 140-149 din 27.05.16), reglementeaz\u0103 drepturile suplimentare ale t\u0103ticilor, fiind g\u00e2ndite pentru a-i sprijini \u0219i a-i \u00eencuraja s\u0103 participe \u00een mod activ la \u00eengrijirea copilului.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ce s-a schimbat \u00een lege legat de concediul paternal?<\/h2>\n\n\n\n<p>P\u00e2n\u0103 ast\u0103zi, \u00een temeiul art. 124<sup>1<\/sup> din Codul Muncii al RM, \u00een primele 56 de zile de la na\u0219terea copilului, orice t\u0103tic care lucreaz\u0103 cu forme legale si posed\u0103 asigurare social\u0103 de stat are dreptul la un concediu paternal pl\u0103tit de 14 zile calendaristice.<\/p>\n\n\n\n<p>Din 1 septembrie 2022, perioada \u00een care un salariat poate solicita s\u0103 i se acorde concediu paternal se extinde de la 56 de zile la 12 luni de la na\u0219terea copilului. Asta conform modific\u0103rilor operate \u00een Codul Muncii (Legea nr. 195 din 14.07.22, MO246-250 din 05.08.22).<\/p>\n\n\n\n<p>Astfel, Concediul paternal se va acord\u0103 \u00een baza unei cereri \u00een form\u0103 scris\u0103, \u00een primele 12 luni de la na\u0219terea copilului. La cerere se anexeaz\u0103 o copie a certificatului de na\u0219tere al copilului.<\/p>\n\n\n\n<p>Cererea \u00een form\u0103 scris\u0103 cu anexarea copiei certificatului de na\u0219tere a nou-n\u0103scutului, pentru acordarea drepturilor prev\u0103zute de art. 124<sup>1<\/sup> din CM al RM, va fi depus\u0103 de c\u0103tre salariat la entitatea unde acesta are \u00eencheiat un contract individual de munc\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Angajatorul are obliga\u021bia s\u0103 acorde concediul paternal<\/h3>\n\n\n\n<p>Angajatorul este obligat s\u0103 accepte aceast\u0103 solicitare \u0219i s\u0103 emit\u0103 un ordin de acordare a concediului paternal. Prevederile legisla\u021biei \u00een vigoare stabilesc c\u0103 angajatorul este obligat s\u0103 declare, \u00een termen de 10 zile lucr\u0103toare din data emiterii ordinului privind acordarea concediului paternal al salaria\u021bilor, perioada afl\u0103rii \u00een concediu paternal al salaria\u021bilor prin intermediul raportului IRM19.<\/p>\n\n\n\n<p>Prin Hot\u0103r\u00e2rea Guvernului nr. 1245 din 15 noiembrie 2016, \u201eRegulamentul cu privire la condi\u021biile de stabilire, modul de calculare \u0219i de plat\u0103 a indemniza\u021biei paternale\u201d (MO Nr. 405- 414 din 25.11.16), se stabile\u0219te metoda de calcul a indemniza\u021biei pentru salaria\u021bii (t\u0103ticii copiilor nou-n\u0103scu\u021bi) asigura\u021bi \u00een sistemul public de asigur\u0103ri sociale, cu un stagiu total de cotizare de cel pu\u021bin 3 ani \u0219i confirm\u0103 un stagiu de cotizare de cel pu\u021bin 9 luni, realizat \u00een ultimele 24 luni premerg\u0103toare datei na\u0219terii copilului.<\/p>\n\n\n\n<p>Stagiul de cotizare se confirm\u0103 prin informa\u021biile din Registrul de stat al eviden\u021bei individuale \u00een sistemul public de asigur\u0103ri sociale.<\/p>\n\n\n\n<p>Pentru a beneficia de concediul paternal, mama sau tat\u0103l copilului depune cerere la Casa Teritorial\u0103 de Asigur\u0103ri Sociale de la locul de domiciliu. Sau online pe portalurile: <a href=\"http:\/\/www.servicii.gov.md\" target=\"_blank\" rel=\"noreferrer noopener\">www.servicii.gov.md<\/a> \u0219i <a href=\"http:\/\/www.cnas.gov.md\" target=\"_blank\" rel=\"noreferrer noopener\">www.cnas.gov.md<\/a>, \u00een termen de 12 luni de la data na\u0219terii copilului.<\/p>\n\n\n\n<p>Pentru stabilirea, calcularea \u0219i plata indemniza\u021biei paternale, salariatul sau so\u021bia acestuia depune o cerere la Casa Teritorial\u0103 de Asigur\u0103ri Sociale de la locul de domiciliu sau re\u0219edin\u021b\u0103. Ori la Casa Teritorial\u0103 de Asigur\u0103ri Sociale \u00een a c\u0103rei raz\u0103 de deservire se afl\u0103 \u00eentreprinderea unde salariatul activeaz\u0103 la locul de munc\u0103 de baz\u0103.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#097d17\" class=\"has-inline-color\">Cite\u0219te \u0219i: <\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#097d17\" class=\"has-inline-color\"><strong><a href=\"https:\/\/dad.md\/dad-human-capital\/serviciul-de-recrutare-dad-human-capital\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ce presupune serviciul de recrutare \u0219i de ce s\u0103 alegi DAD Human Capital<\/a><\/strong><\/mark><\/p>\n<\/blockquote>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2-1024x576.jpg\" alt=\"concediul paternal fotografie simbol\" class=\"wp-image-2396\" srcset=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2-1024x576.jpg 1024w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2-300x169.jpg 300w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2-768x432.jpg 768w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2-1536x864.jpg 1536w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2022\/09\/Concediu-paternal_DAD-Human-Capital-2.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Ce documente sunt necesare?<\/h3>\n\n\n\n<p>La cerere, conform p. 8 din Hot\u0103r\u00e2rea Guvernului Nr. 1245\/2016 \u201eRegulamentul cu privire la condi\u021biile de stabilire, modul de calculare \u0219i de plat\u0103 a indemniza\u021biei paternale\u201d se prezint\u0103 urm\u0103toarele acte:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Actul de identitate (buletinul) tat\u0103lui copilului nou-n\u0103scut (\u00een original \u0219i \u00een copie).<\/li>\n\n\n\n<li>Certificatul de na\u0219tere al copilului (\u00een original \u0219i \u00een copie).<\/li>\n\n\n\n<li>Extrasul din ordinul de acordare a concediului paternal, \u00een original, eliberat de la toate unit\u0103\u021bile \u00een care desf\u0103\u0219oar\u0103 activit\u0103\u021bi.<\/li>\n<\/ol>\n\n\n\n<p>Cererea pentru stabilire indemniza\u021biei paternale se examineaz\u0103 \u00een termen de 30 de zile calendaristice.<\/p>\n\n\n\n<p>Indemniza\u021bia paternal\u0103 se va calcula din venitul mediu lunar al ultimelor 3 luni calendaristice premerg\u0103toare lunii na\u0219terii copilului, conform cap. III al \u201eRegulamentului cu privire la condi\u021biile de stabilire, modul de calculare \u0219i de plat\u0103 a indemniza\u021biei paternale\u201d. Plata indemniza\u021biei paternale se va efectua \u00een luna urm\u0103toare celei \u00een care a fost stabilit\u0103 decizia privind stabilirea indemniza\u021biei paternale. Aceasta indemniza\u021bie se achit\u0103 de c\u0103tre Casa Teritorial\u0103 de Asigur\u0103ri Sociale.<\/p>\n\n\n\n<p>\u00cen caz de coinciden\u021b\u0103 total\u0103 sau par\u021bial\u0103 a concediului paternal cu concediul medical, <strong>concediul paternal<\/strong> nefolosit se prelunge\u0219te. Aceast\u0103 prevedere intr\u0103 \u00een vigoare de ast\u0103zi, 1 septembrie 2022. \u0218i va permite at\u00e2t salaria\u021bilor, c\u00e2t \u0219i angajatorilor sa poat\u0103 acorda corect concediile paternale \u00een cazuri excep\u021bionale.<\/p>\n\n\n\n<p>Refuzul angajatorului de a acorda <strong>concediul paternal<\/strong> se consider\u0103 discriminare din partea angajatorului \u0219i se sanc\u021bioneaz\u0103.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Extras din Codul muncii RM (modificat prin LP 195\/2022)<\/h4>\n\n\n\n<p><strong>Articolul 124<sup>1<\/sup>. Concediul paternal<\/strong><\/p>\n\n\n\n<p>1) Concediul paternal se acord\u0103 \u00een condi\u021biile prev\u0103zute de prezentul articol pentru a asigura participarea efectiv\u0103 a tat\u0103lui la \u00eengrijirea copilului nou-n\u0103scut.<\/p>\n\n\n\n<p>2) Tat\u0103l copilului nou-n\u0103scut beneficiaz\u0103 de dreptul la un concediu paternal de 14 zile calendaristice.<\/p>\n\n\n\n<p>3)<strong> Concediul paternal <\/strong>se acord\u0103 \u00een baza unei cereri \u00een form\u0103 scris\u0103, \u00een primele 12 luni de la na\u0219terea copilului. La cerere se anexeaz\u0103 o copie a certificatului de na\u0219tere al copilului.<\/p>\n\n\n\n<p>3<sup>1<\/sup>) \u00cen caz de coinciden\u021b\u0103 total\u0103 sau par\u021bial\u0103 a concediului paternal cu concediul medical, \u00een baza unei cereri scrise a salariatului, concediul paternal nefolosit integral ori par\u021bial se prelunge\u0219te.<\/p>\n\n\n\n<p>4) Pe perioada concediului paternal, salariatul beneficiaz\u0103 de o indemniza\u021bie paternal\u0103 care nu poate fi mai mic\u0103 dec\u00e2t venitul mediu lunar asigurat pentru perioada respectiv\u0103 \u0219i care este achitat\u0103 din bugetul asigur\u0103rilor sociale de stat.<\/p>\n\n\n\n<p>5) Angajatorul este obligat s\u0103 \u00eencurajeze salaria\u021bii \u00een vederea beneficierii de concediu paternal.<\/p>\n\n\n\n<p>6) Cazurile \u00een care angajatorul creeaz\u0103 situa\u021bii cu efect de dezavantajare a angaja\u021bilor care iau concediu paternal sunt considerate cazuri de discriminare din partea angajatorilor \u0219i se sanc\u021bioneaz\u0103 conform legii.<\/p>\n\n\n\n<p><strong>Dac\u0103 ai nevoie de mai multe informa\u021bii despre acest subiect sau de ajutor \u00een gestionarea
