{"id":1451,"date":"2021-11-09T14:58:51","date_gmt":"2021-11-09T11:58:51","guid":{"rendered":"https:\/\/dad.md\/dad-human-capital\/?p=1451"},"modified":"2024-07-24T16:10:40","modified_gmt":"2024-07-24T13:10:40","slug":"cum-se-programeaza-si-se-acorda-concediul-anual-de-odihna","status":"publish","type":"post","link":"https:\/\/dad.md\/dad-human-capital\/cum-se-programeaza-si-se-acorda-concediul-anual-de-odihna\/","title":{"rendered":"Cum se programeaz\u0103 \u0219i se acord\u0103 concediul anual de odihn\u0103"},"content":{"rendered":"\n<p><strong>Concediul anual de odinh\u0103 <\/strong>este dreptul, garantat de Constitu\u021bia RM \u0219i Codul muncii al RM, la un anumit num\u0103r de zile prev\u0103zute anual pentru odihn\u0103 \u0219i restabilirea capacit\u0103\u021bii de munc\u0103, men\u021bin\u00e2nd \u00een acela\u0219i timp locul de munc\u0103 (func\u021bia) tuturor celor care lucreaz\u0103 \u00een baza unui contract individual de munc\u0103, indiferent de forma organizatoric\u0103 \u0219i juridic\u0103 a \u00eentreprinderii.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Ce este concediul anual de odihn\u0103<\/h1>\n\n\n\n<p>Concediu este o odihn\u0103 ne\u00eentrerupt\u0103 pentru c\u00e2teva zile calendaristice la r\u00e2nd, cu p\u0103strarea locului de munc\u0103 \u0219i a c\u00e2\u0219tigurilor medii. Al\u0103turi de concediul anual de odihn\u0103, exist\u0103 \u0219i alte tipuri de concedii platite, precum ar fi:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pentru incapacitate de munc\u0103 temporar\u0103;<\/li>\n\n\n\n<li>concediu de maternitate;<\/li>\n\n\n\n<li>concediu pentru \u00eengrijirea copilului p\u00e2n\u0103 la 3 ani;<\/li>\n\n\n\n<li>concediu suplimentar;<\/li>\n\n\n\n<li>concediu de studii pentru angaja\u021bii care combin\u0103 munca cu studiile;<\/li>\n\n\n\n<li>concediu patenal.<\/li>\n<\/ul>\n\n\n\n<p>Pe l\u00e2ng\u0103 concediul pl\u0103tit, se acord\u0103 \u0219i concediul f\u0103r\u0103 plat\u0103.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong><em>IMPORTANT !!! <\/em><\/strong>Concediul se acord\u0103 tuturor angaja\u021bilor \u00eentreprinderii care lucreaz\u0103 pe baza unui contract individual de munc\u0103, inclusiv lucr\u0103torilor cu frac\u021biune de norm\u0103, lucr\u0103torilor sezonieri, persoanelor cu care a fost \u00eencheiat un contract individual de munc\u0103 pe durat\u0103 determinat\u0103, angaja\u021bilor prin cumul.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>C\u00e2t dureaz\u0103 concediul anual de odihn\u0103<\/strong><\/h3>\n\n\n\n<p>Conform <a href=\"https:\/\/www.legis.md\/cautare\/getResults?doc_id=142481&amp;lang=ro#\" target=\"_blank\" rel=\"noreferrer noopener\">Codului muncii<\/a>, tuturor angaja\u021bilor li se ofer\u0103 concediu anual pl\u0103tit de cel pu\u021bin 28 de zile calendaristice pe an. <em>\u0218i anume zilele calendaristice, nu zilele lucr\u0103toare!<\/em>. Excluz\u00e2nd zilele de s\u0103rb\u0103torile nelucr\u0103toare.<\/p>\n\n\n\n<p>Perioada concediilor de odihn\u0103 anuale poate fi reglementat\u0103 printr-un contract colectiv de munc\u0103, contract individual de munc\u0103 \u0219i acte normative interne ale \u00eentreprinderii.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong><em>IMPORTANT !!! <\/em><\/strong>Dreptul la concediu de odihn\u0103 anual nu poate fi limitat, anulat sau pierdut \u00een perioada de munc\u0103 la \u00eentreprindere. Acest drept se asigur\u0103&nbsp; prin acordarea de concedii \u00een natur\u0103, care este unul dintre principiile de baz\u0103 ale reglement\u0103rii legale a concediilor de odihn\u0103 anuale.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Concediul de odihn\u0103 <\/strong>este un concediu anual \u0219i este obligatoriu s\u0103 se acorde \u00een fiecare an.<\/p>\n\n\n\n<p>\u00centrebarea principal\u0103 este ce an se sub\u00een\u021belege? Calendaristic (de la 1 ianuarie p\u00e2n\u0103 la 31 decembrie) sau de lucru (care se va calcula de la data angaj\u0103rii)?<\/p>\n\n\n\n<p><strong>R\u0103spunsul corect este &#8211; un an lucr\u0103tor. <\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong><em>EXEMPLU<\/em><\/strong><em>: <\/em>Fiecare angajat al \u00eentreprinderii are propriul calcul al stagiului de munc\u0103, de exemplu: angajatul a \u00eenceput activitatea de munc\u0103 la \u00eentreprindere pe 1 septembrie 2020, anul estimat va fi din 1 septembrie 2020 p\u00e2n\u0103 la 31 august 2021.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Concediul de odinh\u0103 depinde de vechimea \u00een munc\u0103<\/h3>\n\n\n\n<p><strong>Perioadele de munc\u0103 incluse \u00een vechimea muncii la calcularea stagiului pentru<\/strong> <strong>concediu de odihn\u0103 anual:<\/strong><\/p>\n\n\n\n<p>a) timpul c\u00e2nd salariatul a lucrat efectiv;<\/p>\n\n\n\n<p>b) timpul c\u00e2nd salariatul nu a lucrat de fapt. Dar i s-a men\u0163inut locul de munc\u0103 (func\u0163ia) \u015fi salariul mediu integral sau par\u0163ial (sta\u021bionare, \u0219omaj tehnic, etc.);<\/p>\n\n\n\n<p>c) timpul absen\u0163ei for\u0163ate de la lucru. \u00cen cazul eliber\u0103rii nelegitime din serviciu sau transferului nelegitim la o alt\u0103 munc\u0103 \u015fi al restabilirii ulterioare la locul de munc\u0103;<\/p>\n\n\n\n<p>d) timpul c\u00e2nd salariatul nu a lucrat de fapt, dar \u015fi-a men\u0163inut locul de munc\u0103 (func\u0163ia) \u015fi a primit diferite pl\u0103\u0163i din bugetul asigur\u0103rilor sociale de stat. Cu excep\u0163ia concediului par\u0163ial pl\u0103tit pentru \u00eengrijirea copilului p\u00e2n\u0103 la v\u00e2rsta de 3 ani;<\/p>\n\n\n\n<p>e) alte perioade prev\u0103zute de conven\u0163iile colective, de contractul colectiv sau de cel individual de munc\u0103, de regulamentul intern al unit\u0103\u0163ii.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nu se include \u00een vechimea muncii<\/h3>\n\n\n\n<p>Perioadele de munc\u0103 care nu se includ \u00een vechimea muncii la&nbsp;calcularea stagiului pentru concediu de odihn\u0103 anual:<\/p>\n\n\n\n<p>a) timpul absen\u0163ei nemotivate de la lucru;<\/p>\n\n\n\n<p>b) perioada afl\u0103rii \u00een concediu pentru \u00eengrijirea copilului p\u00e2n\u0103 la v\u00e2rsta de 4 ani;<\/p>\n\n\n\n<p>c) perioada afl\u0103rii \u00een concediu nepl\u0103tit cu o durat\u0103 mai mare de 14 zile calendaristice;<\/p>\n\n\n\n<p>d) perioada suspend\u0103rii contractului individual de munc\u0103, cu excep\u0163ia cazurilor prev\u0103zute la art.76 lit.a)-d) \u015fi la art.77 lit.b) din CM.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong><em>IMPORTANT !!! <\/em><\/strong>Contractele colective, reglement\u0103rile interne, contractele individuale de munc\u0103 sau alte reglement\u0103ri interne pot prevedea alte perioade de experien\u021b\u0103 de munc\u0103 care dau dreptul la concediul anual pl\u0103tit. De exemplu: timpul petrecut \u00een concediu f\u0103r\u0103 plat\u0103 de mai pu\u021bin de 30 de zile calendaristice pe parcursul unui an calendaristic<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><span style=\"color:#11700f\" class=\"has-inline-color\">Cite\u0219te \u0219i: <\/span><\/strong><a href=\"https:\/\/dad.md\/dad-human-capital\/concediile-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">Concediile \u00een 2024. Ce trebuie s\u0103 \u0219tie fiecare angajator<\/a><\/p>\n<\/blockquote>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2-1024x576.jpg\" alt=\"concediul de odihn\u0103 fotografie simbol\" class=\"wp-image-1457\" srcset=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2-1024x576.jpg 1024w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2-300x169.jpg 300w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2-768x432.jpg 768w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2-1536x864.jpg 1536w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-Concediile-anuale-2.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cum se acord\u0103 concediul anual<\/strong> <strong>de odihn\u0103<\/strong><\/h3>\n\n\n\n<p><strong>Concediul anual de odihn\u0103 <\/strong>pentru primul an de munc\u0103 se acord\u0103 salaria\u0163ilor dup\u0103 expirarea a 6 luni de munc\u0103 la \u00eentreprinderea respectiv\u0103.<\/p>\n\n\n\n<p>\u00cenainte de expirarea a 6 luni de munc\u0103 la \u00eentreprindere, concediul de odihn\u0103 pentru primul an de munc\u0103 se acord\u0103, \u00een baza unei cereri scrise, urm\u0103toarelor categorii de salaria\u0163i:<\/p>\n\n\n\n<p>a) femeilor \u2013 \u00eenainte de concediul de maternitate sau imediat dup\u0103 el;<\/p>\n\n\n\n<p>b) salaria\u0163ilor \u00een v\u00e2rst\u0103 de p\u00e2n\u0103 la 18 ani;<\/p>\n\n\n\n<p>c) salaria\u0163ilor transfera\u0163i dintr-o unitate \u00een alta;<\/p>\n\n\n\n<p>d) altor salaria\u0163i, conform legisla\u0163iei \u00een vigoare.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong><em>IMPORTANT!!! <\/em><\/strong>Concediul de odihn\u0103 pentru primul an de munc\u0103 poate fi acordat salariatului \u015fi \u00eenainte de expirarea a 6 luni de munc\u0103 la unitate cu acordul angajatorului.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Concediul de odihn\u0103 anual <\/strong>pentru urm\u0103torii ani de munc\u0103 poate fi acordat salariatului \u00een baza unei cereri scrise, \u00een orice timp al anului, conform program\u0103rii stabilite.<\/p>\n\n\n\n<p><strong>Concediul de odihn\u0103 anual <\/strong>poate fi acordat integral. Sau, \u00een baza unei cereri scrise a salariatului, poate fi divizat \u00een p\u0103r\u0163i. Una dintre p\u0103r\u021bi va avea o durat\u0103 de cel pu\u0163in 14 zile calendaristice.<\/p>\n\n\n\n<p><strong>Concediul de odihn\u0103 anual <\/strong>se acord\u0103 salariatului \u00een temeiul ordinului (dispozi\u0163iei, deciziei, hot\u0103r\u00e2rii) emis de angajator.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Programarea concediilor anuale<\/strong> <strong>de odihn\u0103<\/strong><\/h3>\n\n\n\n<p><strong>Concediul de odihn\u0103<\/strong> se acord\u0103 anual conform program\u0103rii prev\u0103zute la art.116 din Codul muncii. La programarea concediilor de odihn\u0103 anuale se \u021bine cont at\u00e2t de dorin\u0163a salaria\u0163ilor, c\u00e2t \u015fi de necesitatea asigur\u0103rii unei bune func\u0163ion\u0103ri a unit\u0103\u0163ii. Programarea concediilor de odihn\u0103 anuale este obligatorie at\u00e2t pentru angajator, c\u00e2t \u015fi pentru salariat. <\/p>\n\n\n\n<p>Mai mult dec\u00e2t at\u00e2t, angajatorul, potrivit art. 118, alin. (1) din Codul muncii, are obliga\u0163ia de a lua m\u0103surile necesare pentru ca salaria\u021bii s\u0103 foloseasc\u0103 concediile de odihn\u0103 \u00een fiecare an calendaristic. Legisla\u021bia nu precizeaz\u0103 cazurile \u00een care angajatorul este obligat s\u0103 acorde concediul de odihn\u0103 anual pe p\u0103r\u021bi.<\/p>\n\n\n\n<p>Pentru a preveni \u00eenc\u0103lcarea legisla\u021biei muncii, articolul 116 din Codul Muncii al Republicii Moldova&nbsp; to\u021bi angajatorii sunt obliga\u021bi s\u0103 elaboreze un program de concedii anuale pl\u0103tite cu cel pu\u021bin <strong><em>dou\u0103 s\u0103pt\u0103m\u00e2ni \u00eenainte de \u00eenceperea noului an calendaristic.<\/em><\/strong><\/p>\n\n\n\n<p>Conform Monitorului Oficial din 6 martie 2020, a intrat \u00een vigoare Conven\u021bia colectiv\u0103 (nivel na\u021bional) nr.19 din 28.02.2020, cu privire la modelul Program\u0103rii concediilor de odihn\u0103 anuale.<\/p>\n\n\n\n<p>\u00centreprinderile pot folosi modelul Program\u0103rii concediilor de odihn\u0103 anuale aprobat prin Conven\u021bia colectiv\u0103 (nivel na\u021bional) nr.19 \/ 2020 sau pot elabora un model de al&nbsp;Program\u0103rii concediilor de odihn\u0103 la nivel de unitate.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Model de Ordin \u0219i Program a concediilor de odihn\u0103<\/h3>\n\n\n\n<p>\u00cen conformitate cu prevederile art. 112-118 din Codul muncii \u0219i lu\u00e2nd \u00een considerare faptul c\u0103 la programarea concediilor de odihn\u0103 anuale se \u021bine cont de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>dorin\u021ba salaria\u021bilor;<\/li>\n\n\n\n<li>necesitatea asigur\u0103rii bunei func\u021bion\u0103ri a unit\u0103\u021bii.<\/li>\n<\/ul>\n\n\n\n<p>1. Ca urmare a condi\u021biilor stipulate \u00een legisla\u021bie \u0219i \u00een CIM, s-a procedat la programarea concediilor de odihn\u0103 anuale a salaria\u021bilor dup\u0103 consultarea \u00een prealabil a acestora.<\/p>\n\n\n\n<p>2. Se aprob\u0103 urm\u0103toarea structur\u0103 a programei concediilor de odihn\u0103 anuale a salaria\u021bilor pentru anual 2022:<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"922\" height=\"405\" src=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-1.jpg\" alt=\"concediul de odihn\u0103 model\" class=\"wp-image-1455\" srcset=\"https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-1.jpg 922w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-1-300x132.jpg 300w, https:\/\/dad.md\/dad-human-capital\/wp-content\/uploads\/sites\/4\/2021\/11\/DAD-Human-Capital-1-768x337.jpg 768w\" sizes=\"auto, (max-width: 922px) 100vw, 922px\" \/><\/figure>\n\n\n\n<p>Codul muncii interzice plata desp\u0103gubirilor \u00een locul concediului anual pl\u0103tit \u00een perioada de angajare a salariatului la \u00eentreprindere. Aceast\u0103 interdic\u021bie se aplic\u0103 \u0219i cazurilor \u00een care exist\u0103 o acumulare de concediu anual pe parcursul mai multor ani.<\/p>\n\n\n\n<p>Dreptul la concediu anual pl\u0103tit face parte din statutul juridic al oric\u0103rui salariat. Salaria\u021bii nu pot renun\u021ba la drepturile prev\u0103zute de Codul muncii. Nici la cele din conven\u021biile colective la nivel de ramur\u0103 \u0219i\/sau la nivel de \u00eentreprindere, precum \u0219i alte regulamente interne ale \u00eentreprinderii.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong>IMPORTANT!!!<\/strong> &nbsp;Orice acord care vizeaz\u0103 renun\u021barea sau restric\u021bionarea drepturilor de angajare ale unui salatiat este nul.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Dac\u0103 nu sunt \u00eendeplinite cerin\u021bele legisla\u021biei muncii, se limiteaz\u0103 sau nu se ofer\u0103 garan\u021bii salaria\u021bilor \u00een asigurarea concediilor anuale sau suplimentare pl\u0103tite, angajatorul poate fi amendat \u00een conformitate cu Codul
