Acordarea concediului de odihn\u0103 anual constituie o garan\u021bie constitu\u021bional\u0103 ce rezult\u0103 din art. 43 alin. (2) din Constitu\u021bie. Conform articolului 112 din Codul Muncii, orice salariat are dreptul s\u0103 beneficieze de un concediu anual pl\u0103tit. Durata acestuia este de 28 de zile calendaristice, cu excep\u021bia zilelor de s\u0103rb\u0103toare sau lucr\u0103toare. Acest drept nu poate fi supus unei cesiuni, renun\u0163\u0103ri sau limit\u0103ri. Totodat\u0103, orice \u00een\u021belegere dintre angajat \u0219i angajator referitor la renun\u021barea la concediul anual este considerat\u0103 nevalid\u0103. Azi vorbim despre <strong>concedii nefolosite<\/strong> \u0219i cum \u0219i dac\u0103 acestea pot fi compensate.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Concedii nefolosite \u2013 \u00een ce circumstan\u021be pot fi compensate<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Majoritatea angajatorilor \u00eent\u00e2mpin\u0103 dificult\u0103\u021bi legate nu at\u00e2t \u00een acordarea concediilor anuale, c\u00e2t de compensarea acestora \u00een cazul \u00een care concediile nu au fost utilizate. Totodat\u0103, cu aceste dificult\u0103\u021bi se pot ciocni \u0219i angaja\u021bii care nu au reu\u0219it s\u0103-\u0219i utilizeze concediile prestabilite de legisla\u021bia \u00een vigoare. \u00cen acest sens, pentru ambele p\u0103r\u021bi devine valabil\u0103 \u00eentrebarea: Cum sunt compensate concediile neutilizate? Se cumuleaz\u0103 acestea sau nu? \u00cen acest articol descriem \u00een detaliu modul \u00een care are loc compensarea concediilor neutilizate \u0219i r\u0103spundem la \u00eentrebarea dac\u0103 acestea se cumuleaz\u0103 sau nu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cite\u0219te \u0219i: <a href=\"https:\/\/dad.md\/dad-human-capital\/concediile-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">Concediile \u00een 2024. Ce trebuie s\u0103 \u0219tie fiecare angajator<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Despre concedii nefolosite. Se cumuleaz\u0103 sau \u201eard\u201d la sf\u00e2r\u0219it de an<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aceasta este o \u00eentrebare actual\u0103 \u00een special \u00een r\u00e2ndul angaja\u021bilor. Deseori angaja\u021bii nu reu\u0219esc s\u0103-\u0219i utilizeze toate zilele din concediul anual. \u00cen acest context devine valabil\u0103 \u00eentrebarea despre cumularea acestora. Pentru a oferi un r\u0103spuns exact la acest subiect vom apela la <strong>punctul (2) din articolul 112, Codul Muncii<\/strong>. Acest punct prevede: \u201eDreptul la concediu de odihn\u0103 anual nu poate fi obiectul vreunei cesiuni, renun\u0163\u0103ri sau limit\u0103ri. Orice \u00een\u0163elegere prin care se renun\u0163\u0103, total sau par\u0163ial, la acest drept este nul\u0103\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anume aceast\u0103 prevedere determin\u0103 faptul c\u0103 angajatul nu poate fi privat sub nici o form\u0103 de dreptul la concediu anual. Concediile anuale nefolosite nu reprezint\u0103 o excep\u021bie &#8211; acestea se cumuleaz\u0103 iar, ulterior, se compenseaz\u0103 \u00een corespundere cu legisla\u021bia \u00een vigoare.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Concedii nefolosite \u2013 forme de compensare<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Cumularea concediilor anuale determin\u0103 existen\u021ba unui alt aspect important &#8211; compensarea acestora. De compensarea concediilor neutilizate poate beneficia orice angajat care nu \u0219i-a utilizat num\u0103rul minim de zile din concediul pl\u0103tit prev\u0103zut de legisla\u021bie. Totodat\u0103, este necesar de men\u021bionat c\u0103 aceast\u0103 compensare poate fi executat\u0103 doar \u00een unul dintre modurile prev\u0103zute de articolul 119 din Codul Muncii al Republicii Moldova:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00cen baza unei cereri scrise, salariatul poate folosi concediul de odihn\u0103 anual pentru un an de munc\u0103, cu suspendarea sau \u00eencetarea ulterioar\u0103 a contractului individual de munc\u0103, primind compensa\u0163ia pentru celelalte <strong>concedii nefolosite<\/strong>. Aceast\u0103 metod\u0103 de compensare a concediilor neutilizate se refer\u0103 la situa\u021bia \u00een care concediul neutilizat este solicitat nemijlocit \u00eenaintea \u00eencet\u0103rii raportului juridic dintre angajat \u0219i angajator.<\/li>\n\n\n\n<li>\u00cen perioada valabilit\u0103\u0163ii contractului individual de munc\u0103, concediile nefolosite pot fi alipite la concediul de odihn\u0103 anual sau pot fi folosite aparte (\u00een \u00eentregime sau frac\u0163ionat, conform art.115 alin.(5)) de c\u0103tre salariat \u00een perioadele stabilite prin acordul scris al p\u0103r\u0163ilor. Aceast\u0103 metod\u0103 se refer\u0103 la situa\u021bia \u00een care p\u0103r\u021bile decid alipirea concediului neutilizat la cealalt\u0103 parte a concediului pl\u0103tit. Astfel, \u00een noul an angajatul va avea un num\u0103r minim de zile libere mai mare dec\u00e2t minimul prev\u0103zut de legisla\u021bia \u00een vigoare (28 zile).<\/li>\n\n\n\n<li>\u00een caz de suspendare (art.76 lit. e) \u015fi m), art.77 lit. d) \u015fi e) \u015fi art.78 alin.(1) lit. a) \u015fi d)) sau \u00eencetare a contractului individual de munc\u0103, salariatul are dreptul la compensarea tuturor concediilor de odihn\u0103 anuale nefolosite. Aceste circumstan\u021be se \u00eentrunesc, de obicei, la \u00eencetarea raportului dintre angajat \u0219i angajator, adic\u0103 la rezilierea contractului de munc\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen acest caz angajatorul este obligat s\u0103 ofere angajatului o remunera\u021bie b\u0103neasc\u0103. Calculul acestei compensa\u021bii financiare este unul asem\u0103n\u0103tor cu cel al indemniza\u021biei pentru concediu. Angajatorul va calcula salariul mediu al angajatului pentru ultimele 3 luni care preced\u0103 suspendarea contractului de munc\u0103. \u00cen continuare angajatorul va calcula salariul mediu per zi al angajatului \u00een cauz\u0103. Ulterior, acest salariul zilnic va fi \u00eenmul\u021bit cu num\u0103rul de zile libere neutilizate de c\u0103tre angajat. \u00cen acest fel angajatorul va reu\u0219i s\u0103 calculeze valoarea
