Te \u00eentrebi ce are asta cu <strong>salariul minim<\/strong>? \u00ce\u021bi spunem noi. Primul salariu a fost achitat \u00een sare. Dac\u0103 te g\u00e2nde\u0219ti c\u0103 descriem experien\u021ba de munc\u0103 a unui ocna\u0219, nu, nu. Totul e mult mai simplu. \u00cen Roma Antic\u0103 solda\u021bii erau remunera\u021bi cu o sold\u0103 (pl\u0103tit\u0103 \u00een bani) \u0219i cu a\u0219a-numitul <em>salarium<\/em> (plata \u00een sare). Da, da, anume \u00een sare. Pe vremuri, aceasta mai era numit\u0103 \u0219i \u201eaur alb\u201d \u0219i se folosea inclusiv ca moned\u0103 de schimb. Dar nu e despre asta. \u00cen timp, sensul cuv\u00e2ntului s-a extins. \u0218i a ajuns la cel pe care \u00eel folosim ast\u0103zi. \u0218i anume contravaloarea muncii prestate de salariat \u00een baza contractului individual de munc\u0103, care cuprinde: salariul de baz\u0103, indemniza\u021biile, sporurile \u0219i alte adaosuri.&nbsp;<\/p>\n\n\n\n<p>Apropo, m\u0103rimea salariului se stabile\u0219te la \u00eencheierea contractului de munc\u0103 \u0219i se achit\u0103 pe unitate de timp numai \u00een bani. Adic\u0103, nu \u00een servicii sau alte bunuri (a\u0219a c\u0103 sarea iese din ecua\u021bie). Totu\u0219i, suma acestei remuner\u0103ri nu poate fi mai mic\u0103 dec\u00e2t <strong>salariul minim<\/strong> garantat.<\/p>\n\n\n\n<p>Despre <strong>salariul minim<\/strong> pe economie s-a tot discutat \u0219i discutat. Pentru unii (angajatori) e prea mare. Pentru al\u021bii (angaja\u021bi) e prea mic. Cert e c\u0103 m\u0103rimea acestuia ar trebui analizat\u0103 \u00eentotdeauna \u00een raport cu m\u0103rimea co\u0219ului minim de consum.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Ce este salariul minim garantat \u0219i care este acesta?<\/strong><\/h1>\n\n\n\n<p><strong>Salariul minim<\/strong> garantat este valoarea cea mai mic\u0103 a salariului orar, zilnic sau lunar (calculat \u00een moneda na\u021bional\u0103), pe care legea unei \u021b\u0103ri permite angajatorilor s\u0103-l acorde unui salariat pentru o munc\u0103 simpl\u0103, care nu necesit\u0103 calificare.<\/p>\n\n\n\n<p>Altfel spus, pentru ca to\u021bi oamenii care activeaz\u0103 legal s\u0103-\u0219i poat\u0103 asigura un trai decent, \u00een special cei din categoria defavorizat\u0103 (muncitorii necalifica\u021bi), statul a stabilit un anumit salariu minim \u0219i niciun agent economic nu are voie s\u0103 achite mai pu\u021bin dec\u00e2t at\u00e2t (mai mult se poate \u0219i chiar e de dorit).<\/p>\n\n\n\n<p>Indiferent de dorin\u021ba sau posibilit\u0103\u021bile angaja\u021bilor, ace\u0219tia nu pot mic\u0219ora cuantumul salariului minim garantat \u00een niciun caz. Nici prin contractul colectiv de munc\u0103 \u0219i nici prin contractul individual de munc\u0103.<\/p>\n\n\n\n<p>De re\u021binut c\u0103 <strong>salariul minim<\/strong> nu include: adaosurile, sporurile, pl\u0103\u021bile de stimulare \u0219i compensare.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Salariul minim garantat \u2013 cum se stabile\u0219te<\/strong><\/h2>\n\n\n\n<p>Cuantumul salariului minim garantat se stabile\u0219te de c\u0103tre Guvern dup\u0103 consultarea patronatelor \u0219i a sindicatelor. Acesta se reexamineaz\u0103 anual \u0219i depinde de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Condi\u021biile economice din \u021bar\u0103;<\/li>\n\n\n\n<li>Cre\u0219terea pre\u021burilor;<\/li>\n\n\n\n<li>Nivelul salariului mediu pe economia na\u021bional\u0103;<\/li>\n\n\n\n<li>Nivelul prognozat al ratei infla\u021biei;<\/li>\n\n\n\n<li>Al\u021bi factori social-economici.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Salariul minim garantat \u00een 2024<\/h3>\n\n\n\n<p><strong>S\u0103 trecem la cifre<\/strong><\/p>\n\n\n\n<p>\u00cencep\u00e2nd cu data de <strong><em>1 ianuarie 2024<\/em><\/strong>, <strong>salariul minim<\/strong> garantat \u00een sectorul real (la \u00eentreprinderi, organiza\u021bii, institu\u021bii cu autonomie financiar\u0103, indiferent de tipul de proprietate \u0219i forma de organizare juridic\u0103), a fost majorat la <strong><em>29,58<\/em><\/strong> <strong><em>lei<\/em><\/strong> pe or\u0103 sau <em><a href=\"https:\/\/social.gov.md\/comunicare\/salariul-minim-pe-tara-in-anul-2024-va-constitui-5000-lei-in-crestere-cu-25-fata-de-anul-2023\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>5 000<\/strong> <strong>de lei<\/strong><\/a><\/em> pe lun\u0103, calculat pentru un program complet de lucru de <strong><em>169<\/em><\/strong> ore pe lun\u0103.<\/p>\n\n\n\n<p>\u00cen func\u021bie de calificare, vechimea \u00een munc\u0103, gradul de preg\u0103tire profesional\u0103 \u0219i de competen\u021b\u0103 al salariatului, precum \u0219i de gradul de r\u0103spundere pe care \u00eel implic\u0103 func\u021biile\/lucr\u0103rile executate \u0219i complexitatea lor, exist\u0103 mai multe categorii de salarizare. Astfel, <strong>salariul minim<\/strong> garantat este salariul pe care \u00eel vor primi salaria\u021bii din categoria I (adic\u0103, salaria\u021bii necalifica\u021bi cum ar fi: muncitorii auxiliar, hamalii, \u00eengrijitorii de \u00eenc\u0103peri etc.) Salariile angaja\u021bilor din celelalte categorii de salarizare vor fi calculate pornind de la acela\u0219i salariu minim garantat \u00eenmul\u021bit cu un anumit coeficient de multiplicare, stabilit prin lege \u00een func\u021bie de nivelul de preg\u0103tire profesional\u0103.<\/p>\n\n\n\n<p>At\u00e2t \u00een sectorul bugetar, c\u00e2t \u0219i \u00een cel antreprenorial, se aplic\u0103 <strong><em>Re\u021beaua tarifar\u0103 unic\u0103<\/em><\/strong>, stabilit\u0103 prin lege.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Categorii de angaja\u021bi<\/strong> <strong>dup\u0103 nivelul de preg\u0103tire profesional\u0103<\/strong><\/td><td><strong>Coeficientul de multiplicitate fa\u021b\u0103 de&nbsp;cuantumul minim garantat al salariului \u00een sectorul real<\/strong><\/td><td><strong>Cuantumul&nbsp; minim al salariului<\/strong><\/td><\/tr><tr><td>Muncitori necalifica\u021bi<\/td><td>1,0<\/td><td>5 000<\/td><\/tr><tr><td>Muncitori de calificare medie<\/td><td>1,20<\/td><td>6 000<\/td><\/tr><tr><td>Muncitori de calificare superioar\u0103<\/td><td>1,40<\/td><td>7 000<\/td><\/tr><tr><td>Speciali\u0219ti<\/td><td>1,50<\/td><td>7 500<\/td><\/tr><tr><td>Personal de conducere<\/td><td>2,00<\/td><td>10 000<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Care sunt principalele sisteme de salarizare?<\/strong><\/h3>\n\n\n\n<p>\u00cen func\u021bie de forma juridic\u0103 de organizare a unit\u0103\u021bii, de modul de finan\u021bare \u0219i caracterul activit\u0103\u021bii acesteia, se stabile\u0219te sistemul de salarizare. Iar pe baza sistemului de salarizare se determin\u0103 salariile angaja\u021bilor.<\/p>\n\n\n\n<p>Dac\u0103 conduci o afacere cu finan\u021bare privat\u0103, atunci vei decide formele \u0219i condi\u021biile de salarizare \u00een urma unor negocieri colective. De asemenea, po\u021bi negocia individual cu fiecare angajat sau cu reprezentan\u021bii acestuia, \u021bin\u00e2nd cont de posibilit\u0103\u021bile financiare ale companiei tale. Dup\u0103 ce ve\u021bi ajunge la un numitor comun, deciziile vor fi fixate \u00een contractele colective \u0219i individuale de munc\u0103.<\/p>\n\n\n\n<p>\u00cen sectorul privat, adic\u0103 \u00een afaceri poate fi aplicat sistemul tarifar de salarizare sau sistemul netarifar de salarizare, iar \u00een sectorul bugetar se aplic\u0103 un sistem unic de salarizare.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Sistemul tarifar de salarizare<\/strong><\/h3>\n\n\n\n<p>Sistemul tarifar de salarizare reprezint\u0103 totalitatea normativelor care determin\u0103 diferen\u021bierea salariului, \u00een func\u021bie de cantitatea, calitatea \u0219i condi\u021biile de munc\u0103 \u0219i include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>re\u021belele tarifare;<\/li>\n\n\n\n<li>salariile tarifare;<\/li>\n\n\n\n<li>coeficien\u021bii tarifari,<\/li>\n\n\n\n<li>grilele de salarii ale func\u021biei;<\/li>\n\n\n\n<li>\u00eendrum\u0103rile tarifare de calificare.<\/li>\n<\/ul>\n\n\n\n<p>\u00cen sectorul afacerilor, re\u021beaua tarifar\u0103 se stabile\u0219te prin negociere. Chiar \u0219i a\u0219a, cuantumul minim garantat al salariului \u00een sectorul real serve\u0219te drept limit\u0103 minim\u0103 \u0219i garan\u021bie a statului.<\/p>\n\n\n\n<p>\u00cen caz ca la nivel de unitate nu a fost stabilit sistemul de salarizare prin contractul colectiv de munc\u0103, se consider\u0103 c\u0103, la elaborarea \u0219i aprobarea statelor de personal, unitatea se va \u00eendruma de coeficien\u021bii de multiplicitate ale Re\u021belei tarifare unice de salarizare, recomandat\u0103 prin HG Nr. 743\/2002 (anexele 1, 2, 3, 4, 5 si 6).<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><em>Reprezentan\u021bii inspec\u021biei muncii recomand\u0103 unit\u0103\u021bilor care doresc s\u0103 introduc\u0103 sistemul netarifar de salarizare s\u0103 stabileasc\u0103 acest tip de sistem de salarizare prin Contractul colectiv de munc\u0103 sau prin Regulamentul de salarizare al unit\u0103\u021bii.<\/em> <em>Recomandarea respectiv\u0103 pentru stabilirea sistemului netarifar de salarizare prin Regulamentul de salarizare contravine art. 136<sup>1<\/sup><\/em> <em>alin.<\/em> <em><sup>&nbsp;<\/sup>(3) din CM.<\/em> <em>\u00cen prezent, \u00een Parlamentul RM se examineaz\u0103 modificarea articolului dat pentru a fi ad\u0103ugat\u0103 \u0219i posibilitatea legal\u0103 de a stabili sistemul netarifar de salarizare prin alte documente normative la nivel de unitate.<\/em><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Retribuirea muncii<\/h3>\n\n\n\n<p>\u00cen func\u021bie de specificul afacerii sau \u00een\u021belegerea dintre salariat si angajator poate fi stabilit\u0103 retribu\u021bia muncii pe unitate de timp (la or\u0103) sau \u00een acord.<\/p>\n\n\n\n<p>Prin acordul dintre salariat \u0219i angajator, conform art. 97 alin.&nbsp; (1) din Codul Muncii, se poate stabili, at\u00e2t la momentul angaj\u0103rii la lucru, c\u00e2t \u0219i mai t\u00e2rziu, ziua de munc\u0103 par\u021bial\u0103 sau s\u0103pt\u0103m\u00e2na de munc\u0103 par\u021bial\u0103.<\/p>\n\n\n\n<p>Retribuirea muncii \u00een cazul stabilirii retribu\u021biei pentru unitate de timp se va efectua propor\u021bional timpului lucrat.<\/p>\n\n\n\n<p>Salarizarea pe unitate de timp se execut\u0103 \u021bin\u00e2nd cont de <strong>salariul minim<\/strong> garantat \u0219i calificarea salariatului \u00een func\u021bie de sistemul de salarizare aprobat la unitate.<\/p>\n\n\n\n<p>Retribuirea muncii \u00een caz de efectuare a lucr\u0103rilor (\u00een acord) se va efectua&nbsp; conform tarifelor lucr\u0103rii efectuate. Tarifele lucr\u0103rilor efectuate se aprob\u0103 la nivel de unitate prin Regulamentul intern al unit\u0103\u021bii sau Regulamentul de salarizare, aduse la cuno\u0219tin\u021ba salaria\u021bilor. La elaborarea tarifelor lucr\u0103rilor se \u021bine cont de <strong>salariul minim<\/strong> garantat \u0219i de calificarea salariatului \u00een func\u021bie de sistemul de salarizare aprobat la unitate.<\/p>\n\n\n\n<p>Acest sistem se folose\u0219te preponderent la \u00eendeplinirea lucr\u0103rilor \u00een agricultur\u0103 \u0219i \u00een construc\u021bie.<\/p>\n\n\n\n<p>Modificarea m\u0103rimii salariului se permite cu respectarea prevederilor art. 68 alin. (1) din Codul Muncii printr-un acord suplimentar semnat de p\u0103r\u021bi, care se anexeaz\u0103 la contractul individual de munc\u0103 \u0219i este parte integrant\u0103 a acestuia.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">C\u00e2nd nu ai dreptul s\u0103 reduci salariile prev\u0103zute \u00een CIM<\/h3>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong>IMPORTANT!!! Nu ai voie s\u0103 reduci salariile prev\u0103zute \u00een contractele de munc\u0103 individuale \u0219i colective dac\u0103 \u00eenc\u0103 nu a trecut un an de la data la care acestea au fost stabilite.<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Sporurile de compensare<\/h3>\n\n\n\n<p>Pentru munca \u00een condi\u021bii nefavorabile se stabile\u0219te sporuri de compensare \u00een m\u0103rime unic\u0103 pentru salaria\u021bii de orice calificare, care muncesc \u00een condi\u021bii egale la unitatea respectiv\u0103.<\/p>\n\n\n\n<p>M\u0103rimea concret\u0103 a sporurilor de compensare pentru munca prestat\u0103 \u00een condi\u021bii nefavorabile se stabile\u0219te \u00een func\u021bie de greutate \u0219i nocivitate, \u00een limitele negociate de partenerii sociali \u0219i aprobate prin conven\u021bia colectiv\u0103 la nivel na\u021bional \u0219i ramural, conform prevederilor HG&nbsp; Nr. 1335 din 10.10.2002 despre aprobarea Regulamentului cu privire la evaluarea condi\u021biilor de munc\u0103 la locurile de munc\u0103 \u0219i modul de aplicare a listelor ramurale de lucr\u0103ri pentru care pot fi stabilite sporuri de compensare pentru munca prestat\u0103 \u00een condi\u021bii nefavorabile.<\/p>\n\n\n\n<p>Angajatorul are dreptul s\u0103 stabileasc\u0103 diferite sisteme de premiere, de adaosuri \u0219i sporuri la salariul de baz\u0103, alte pl\u0103\u021bi de stimulare dup\u0103 consultarea reprezentan\u021bilor salaria\u021bilor. Aceste sisteme pot fi, de asemenea, stabilite printr-un contract colectiv de munc\u0103 sau alt document normativ la nivel de unitate.<\/p>\n\n\n\n<p>Pe l\u00e2ng\u0103 pl\u0103\u021bile prev\u0103zute de sistemele de salarizare, pentru salaria\u021bii unit\u0103\u021bii se poate stabili o recompens\u0103 \u00een baza rezultatelor activit\u0103\u021bii anuale din fondul format din beneficiul ob\u021binut de unitate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce risc\u0103 angajatorii care nu respect\u0103 legea<\/h3>\n\n\n\n<p>\u0218tim c\u0103 e\u0219ti un cet\u0103\u021bean responsabil \u0219i un manager exemplar. A\u0219a c\u0103 nu admi\u021bi nici m\u0103car g\u00e2ndul c\u0103 ai putea \u00eenc\u0103lca vreo prevedere a Codului Muncii. \u0218i foarte bine faci, pentru c\u0103 neacordarea garan\u021biilor \u0219i a compensa\u021biilor prev\u0103zute de Codul Muncii se sanc\u021bioneaz\u0103. Dac\u0103 e\u0219ti persoan\u0103 fizic\u0103, vei primi o amend\u0103 de la 30 la 60 de unit\u0103\u021bi conven\u021bionale. \u00cen cazul persoanei cu func\u021bie de r\u0103spundere \u2013 o amend\u0103 de la 70 la 120. Iar c\u00e2nd o persoan\u0103 juridic\u0103 refuz\u0103 s\u0103 acorde garan\u021biile \u0219i compensa\u021biile prev\u0103zute de lege, va primi o amend\u0103 de la 150 la 240 de unit\u0103\u021bi conven\u021bionale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Salariul minim pe economie. Sanc\u021bionarea muncii nedeclarate<\/h3>\n\n\n\n<p>De asemenea, se sanc\u021bioneaz\u0103 \u0219i utilizarea muncii nedeclarate. Sau achitarea salariilor sau a altor pl\u0103\u021bi f\u0103r\u0103 reflectarea acestora \u00een eviden\u021ba contabil\u0103.<\/p>\n\n\n\n<p>Utilizarea muncii nedeclarate se sanc\u021bioneaz\u0103 conform art. 55<sup>1<\/sup>&nbsp; din Codul contraven\u021bional.<\/p>\n\n\n\n<p><em>\u201e<\/em>S<em>e sanc\u021bioneaz\u0103 pentru fiecare persoan\u0103 identificat\u0103 cu amend\u0103 de la 60 la 90 de unit\u0103\u021bi conven\u021bionale aplicat\u0103 persoanei fizice, cu amend\u0103 de la 150 la 210 de unit\u0103\u021bi conven\u021bionale aplicat\u0103 persoanei cu func\u021bie de
